About This Policy

This document details our Acceptable Use Policy (the "Policy"). In this Policy, the terms ‘we’, ‘our’, ‘us’, and ‘Vysion’ refer to Vysion Group Pty Ltd ABN 60 677 898 949 and its affiliated corporate entities. This Policy can be accessed on our website and is shared with both current and former customers (collectively referred to as ‘customers’) as well as our staff. Our Chief Executive Officer (or the equivalent position) has approved this Policy and is accountable for its implementation, operation, and compliance with all relevant regulations and industry standards. By utilizing any Vysion service (‘Services’), you agree to abide by the terms outlined in this Acceptable Use Policy.

Our Principles

The aim of this Policy is to enable Vysion to deliver high-quality services to all customers while ensuring that no customer faces disadvantages due to the actions of others. This includes preventing usage patterns that lead to significant network congestion, disruptions, or other adverse effects on the Vysion network, our suppliers’ networks, or other users’ access to internet services. Furthermore, the Acceptable Use Policy defines your responsibilities when using the internet, including any content published online or through email. It describes the steps we may take to enforce this Policy and our obligations to comply with directives from regulatory and law enforcement agencies. Additionally, it explains how we provide certain streaming services and the measures we implement to manage our network during times of congestion. This Acceptable Use Policy is applicable to all of our services.

General Guidelines

If you are a residential customer (home internet), our services are intended solely for personal use and cannot be utilized for commercial purposes. For business customers, our services are designed for typical business use. You may not use the service in a manner that is considered ‘unreasonable’ or ‘unacceptable’.

Unlimited Data Allowance

The term ‘unlimited’ signifies that there are no limits on the amount of data you can download or upload and that this data will not count against your service quota. While Vysion provides a data usage meter for informational purposes to display the volume of data recorded on your service, be aware that your service may be temporarily throttled to a lower speed if used for excessive data traffic over a short duration. Although this service promotes unlimited data access, various factors beyond Vysion's control may impact your experience. Congestion within the wholesale supplier's backhaul may lead to inconsistent speeds throughout the day. Additionally, access to international bandwidth can be influenced by the destination you are attempting to reach and the traffic management strategies of that site.

Unreasonable Use

Your usage of the service is deemed unreasonable if it strays from its intended purpose. Below are examples of what we consider ‘unreasonable’ usage; this list is not exhaustive:

  • If you are a residential customer utilizing the service in a manner that does not reasonably represent personal use (e.g., using residential products for commercial purposes).
  • If you are a business customer employing the service in a manner that does not reflect standard business use.
  • Engaging in fraudulent activities using the service.
  • Exhibiting abnormal or excessive usage of back-to-base services.
  • Using the service for wholesale provision of any service (including transit, refile, or aggregation of any domestic or international traffic) on our network.
  • Engaging in service arbitrage.
  • Utilizing the service for anything other than standard person-to-person communications.

Unacceptable Use

You must not use our services in any manner that improperly interferes with another person’s usage or for illegal purposes. The use of any unauthorized devices or equipment on our network is prohibited. Below are examples of what we classify as ‘unacceptable’ usage; this list is not exhaustive:

  • Providing false user information to access the service.
  • Employing any unauthorized equipment or devices on our network.
  • Using the service to send unsolicited commercial electronic messages.
  • Gaining improper access to another individual’s private or personal data.
  • Distributing or making accessible any indecent, obscene, offensive, pornographic, illegal, or confidential materials.
  • Defaming, harassing, or abusing anyone or violating their privacy rights.
  • Violating any relevant laws while using the service.
  • Contacting emergency services when there is no actual emergency.
  • Distributing or making available misleading or deceptive material regarding your identity.
  • Infringing on the intellectual property rights of others, including copyright, through the use of the service.
  • Monitoring data or traffic on any system without proper authorization from the system's owner.
  • Using the service in a way that disrupts or interferes with anyone else's ability to use the service or any connected computer system.
  • Attempting unauthorized access to any computer, system, or network via the service.
  • Engaging in actions that compromise the security or disrupt the operation of the service or any other related system or network.

Your Internet Usage

When our products and services provide internet access, you are responsible for any use or misuse of the services, regardless of whether such use occurs with or without your consent. You assume all associated risks with the use of a Vysion service. Vysion disclaims any responsibility or liability concerning your internet usage. For further information on online safety, please reach out to us about filtering or security solutions for your service. You hold responsibility for any content you publish online or send via email. We advise you to take appropriate precautions and warnings related to content that may not be suitable for children. You are also required to adhere to any rules set forth by third parties whose content or services you access through your Vysion service. Copying, publishing, redistributing, or otherwise commercially exploiting such material in any form or by any means without explicit approval from the content provider is strictly forbidden, including framing, linking, and posting in newsgroups. We reserve the right to block, remove, or refuse to publish any content we determine to be offensive, indecent, unlawful, or otherwise inappropriate, regardless of its legal status. We may also be directed by regulatory or law enforcement authorities to remove certain content from our servers or restrict access to specific materials, including those protected by copyright.

Monitoring Compliance

We are not obligated to monitor your transmissions or any content published using our service. However, we may occasionally monitor transmissions or published content to protect our network, our customers, and the general public, and to ensure adherence to the terms of this policy. We may share any findings with regulatory authorities as required. We have obligations to monitor communications traffic on our network and retain relevant data. To reduce spam on our network, we may:

  • Limit your ability to forward emails.
  • Restrict your access to a closed user group that aligns with your service use.
  • Require correction of any improperly configured mail and/or proxy settings.
    We may disclose your username, IP address, and other identifying information to law enforcement when required.

Breaches of the Acceptable Use Policy

Should you violate any aspect of this Acceptable Use Policy, we will reach out to you and, if necessary, request modifications to your use of the service. If you do not adjust your usage according to our request, we reserve the right to suspend or terminate your service without prior notice. In serious cases, such as illegal activity or atypical usage, we may immediately suspend or terminate your service without notice. Upon cancellation of your account, we are authorized to delete any files, programs, data, and email messages related to your account.
